MichiMarket hosts content uploaded by its users: photos of cards, custom and merged pocket artwork, binder layouts, listings, and profile images. We respect the intellectual property rights of others and expect our users to do the same. This policy explains how to ask us to remove content you believe infringes your rights, how the affected user can respond, and what happens to accounts that infringe repeatedly. It operates alongside our Terms of Service.
This policy covers material stored or displayed on MichiMarket at the direction of a user, including:
It does not cover Pokémon card names, numbers, and reference imagery drawn from our third-party card-data provider and shown for identification only; see Section 8.
Send notices to our designated agent for copyright claims:
For infringement of a U.S. copyright, notices are processed under the Digital Millennium Copyright Act, 17 U.S.C. § 512. For rights outside U.S. copyright (trademark, right of publicity, privacy, or a counterfeit/pirated listing), see Section 7; the same contact address applies.
To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following. An incomplete notice may delay or prevent action.
If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to [email protected]. Under 17 U.S.C. § 512(g), it must include:
If we receive a valid counter-notice, we forward it to the original complainant. We may restore the removed material in 10 to 14 business days unless the complainant tells us they have filed a court action seeking to keep it down.
We terminate, in appropriate circumstances, the accounts of users who infringe repeatedly. Copyright strikes are tracked against a seller's account the same way our in-app content reports are: an upheld report counts as a strike, and an account reaching the strike limit is suspended, its listings pulled, and any pending purchases of its listings cancelled. Serious or clearly willful infringement can result in immediate termination without a strike count.
Use the same contact address for content that isn't a copyright issue but still shouldn't be here:
Any MichiMarket user can also flag a listing from its product page with the Report button; a reviewer looks at every report and can take a listing down, strike the seller, and clear it from open carts.
MichiMarket is an independent marketplace. It is not produced, endorsed, sponsored, or affiliated with Nintendo, The Pokémon Company, Creatures Inc., or GAME FREAK inc. Pokémon card names, numbers, and reference images shown on MichiMarket are trademarks and/or copyrighted works of their respective owners, used for identification and reference only, and are sourced from a third-party card-data provider rather than uploaded by users. Concerns about that reference material can be sent to the address in Section 2 and will be routed to the provider or handled directly as appropriate.
Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Don't send a notice or counter-notice for content you don't have the rights to act on.
We may update this policy from time to time; material changes will be posted here. Questions that aren't themselves a notice can go to [email protected].
