These Terms of Service ("Terms") govern your access to and use of MichiMarket ("MichiMarket," "we," "us," or "our"), including the website, the binder builder, and the marketplace for binder templates. By creating an account or using MichiMarket, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use MichiMarket.
You must be at least 13 years old to create an account. If you're under the age of legal majority where you live, you may only use MichiMarket with the involvement of a parent or legal guardian, including for any purchase or sale. By creating an account, you confirm the information you provide is accurate and that you have the legal capacity to agree to these Terms.
You can browse Explore, Shop, and public binders without an account. An account is only required to build your own binder, buy or sell a template, or interact with other collectors (follow, like, save). You're responsible for keeping your login credentials secure and for everything that happens under your account. Tell us right away if you think your account has been compromised.
MichiMarket uses essential cookies to run the service and, only if you consent, analytics (our own usage measurement and Google Analytics) to understand how it's used, never advertising. What we collect, how long we keep it, and how to accept or withdraw analytics consent is set out in the Privacy Policy, which forms part of these Terms.
A binder template (an "Insert") is a digital layout: which card goes in which pocket, how a page or section is organized and color-matched, not a physical product and not the underlying card artwork itself. Buying an Insert grants you a personal, non-exclusive, non-transferable, non-commercial license to apply that layout inside your own MichiMarket binder, or to print it for your own physical binder. It doesn't transfer ownership of, or any rights in, the Pokémon card images, names, or artwork the layout references (see Section 7), and it can't be used to produce anything you sell, distribute, or otherwise offer to anyone else, printed copies included. Free listings work the same way, just without a purchase.
Content sourced from a purchased Insert is tied to that purchase: you can't resell it as your own listing or copy it out of MichiMarket wholesale (the binder builder enforces this automatically: a page containing a purchased Insert's content can't be listed for resale or fully duplicated). Layouts you built yourself, from your own collection, are yours to list, copy, or export freely.
Purchases and seller payouts are processed by Stripe, Inc. ("Stripe"). MichiMarket never sees or stores your full card number; that's handled entirely by Stripe under its own security standards. All purchases are final and non-refundable: an Insert is a digital product delivered instantly to your account, not something that can be returned. If a charge itself was in error (a duplicate charge, say), contact us and we'll look into it.
If you sell on MichiMarket, your payout is handled through Stripe Connect, and opening a seller account means you're also agreeing to the Stripe Connected Account Agreement. A payout isn't instant: we send your share once the buyer's own payment has actually cleared with Stripe, which for a card payment is typically a few business days, not immediately on sale, and can take longer for some payment methods. From there, how quickly it reaches your bank follows your own Stripe payout schedule, visible in your connected Stripe account. If your payout currency differs from the currency a sale was made in, Stripe may convert it, and a currency-conversion cost can apply as part of that conversion.
Your payout is the sale price, minus any applicable MichiMarket cut (Section 4), minus Stripe's own fees for that sale: its standard card-processing fee, and a currency-conversion fee if a conversion was needed. Those are Stripe's charges for moving the money, not MichiMarket's, and apply the same way whether MichiMarket's own cut is 0% or not.
You can upload your own images to a binder pocket (a photo of a card you own, for example). You keep ownership of anything you upload. By uploading, you give MichiMarket a license to store, host, and display that image as part of operating the service (showing it back to you, rendering it into an export, showing it publicly if your binder is public). You're responsible for making sure you have the right to upload what you upload, and that it isn't illegal, infringing, obscene, or otherwise in violation of these Terms. We can remove content or suspend an account that violates this. Pokémon card names, numbers, images, and related properties displayed on MichiMarket are trademarks and/or copyrighted works of their respective owners (Nintendo, Creatures Inc., GAME FREAK inc., and/or The Pokémon Company), used here for identification and reference only. MichiMarket is not produced, endorsed, sponsored, or affiliated with any of them. Market price data shown on MichiMarket is sourced from a third-party pricing service, provided for informational purposes only, may be delayed or inaccurate, and is not investment, financial, or appraisal advice. Don't rely on it for a real transaction without independent verification.
You can stop using MichiMarket and request account deletion at any time (see the Privacy Policy for how). We may suspend or terminate your access if you violate these Terms, with notice where reasonably possible.
MichiMarket is provided "as is," without warranties of any kind, to the extent permitted by law. We don't guarantee the service will be uninterrupted, error-free, or that card pricing data will be accurate. To the extent permitted by law, MichiMarket isn't liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing here limits liability that can't be limited under applicable law.
We may update these Terms from time to time. If a change is material, we'll make reasonable efforts to let you know (e.g. on this page, or by email). Continuing to use MichiMarket after a change takes effect means you accept the updated Terms.
These Terms are governed by the laws of [jurisdiction to be confirmed], without regard to its conflict-of-law principles, except where local consumer-protection law requires otherwise.
